Role of local council

If you are planning a food business contact the environmental health officer (EHO) at the local council where the business will operate. Councils are responsible for the enforcement of food safety standards and the local EHO can help you with compliance information, including that associated with the construction of premises and the types of equipment you will need.

Legislation

The various activities of the food industry are governed by several pieces of legislation:

  • Overarching legislation comprises the South Australian Food Act 2001 and the Food Regulations 2002. These are administered between the Department of Health and local councils.
  • The majority of food businesses are inspected by local government EHOs for compliance with food safety standards. The Australia and New Zealand food standards code aims to ensure food labelling provides consumers with the information they need to make informed and healthy choices in the food they buy. The code is adopted under the Food Regulations 2002.
  • The food industry comprises mainly small businesses with fewer than 20 staff members. Workers must receive their minimum entitlements and work in a safe environment.
